Establish Paternity For Support, Custody And Visitation
Outside of marriage, a father must establish paternity to receive custody or visitation rights. Likewise, a mother must establish paternity if she is seeking support payments from the father.
There are two ways to establish paternity in New York. First, the parties can voluntarily sign an Acknowledgement of Paternity, which is then filed with the court. Second, you may petition the court to determine paternity through a paternity test.
After paternity has been established, a parent can petition the court for child custody, visitation rights and child support. Additionally, the father can take steps to have his name added to the birth certificate, and the child may be able to obtain health insurance under the father’s policy.
